should bach have been prosecuted?

In the Medieval/Renaissance and into the baroque, composers were deeply connected to the Church.
The Church could and did dictate which themes could be covered, as well as regulated the rules of music theory,

Do you think it was fair that J.S. Bach could have been prosecuted if he violated these rules?
