Yeah its a ticket just like pretty much all road offenses (not including drink driving). You have a certain amount of time to send in a complaint and then if unsatisfied you can take it to court (as if it weren't a ticket). At that point the police have to prove beyond reasonable doubt that you were on the phone. I haven't heard of any issues of it being abused or people not getting fair court hearings over here - even on the make stuff up current affairs shows.

Most places I have heard of allow hands free devices. That said, I generally have to really holler to be heard on a cell phone, (my voice just never carries on a phone)and with a hands free device that means I just wear my voice out stupid fast.

Yeah hands free are allowed over here.
