Well, it does matter. Because the United States doesn't have jurisdiction over Julian Assange. And to say that they ought to is, if we apply your logic consistently, the same as saying that North Korea ought to be able to come arrest an American journalist who leaked their secrets.

However, if you're referring to Bradley Manning, then yes, the United States does have jurisdiction over him.
