Case is made vs. US marriage law

Case is made vs. US marriage law - The Boston Globe

It will be interesting to see how this judge rules. It will mostly likely end up before the Supreme Court. Now whether they choose to hear the case? I don't know.

I'm not sure where I stand on this. On the one hand, morally, I'm against same-sex marriage. On the other hand, I don't think marriage is a government issue, so I don't see why civil unions should not be allowed to occur regardless of gender. Marriage is a religious thing --- civil unions are just a way to put it on paper and get tax breaks and a legally binding contract for it (sure, over-simplification, but understand the gist of what I'm saying). I'll be interested to see where this goes.

As much as I am against gay marriage- teh federal government has no authority to define marriage. It does have authority to give tax breaks to married couples and to decide who does and does not get tax breaks and how much , but teh DMA is not within the perview of the fed.

With that being said, there is also a problem arising because states are bound to honor contracts made in other states. So if a gay couple in MAss. gets legally married in MAss, then Utah must recognize the marriage as valid- it will be an interesting court debate.
