Rahim Jaffer

Rahim Jaffer pleads guilty to careless driving - The Globe and Mail

Everybody is saying that he got special treatment due to his politician status. I'm not sure thats the case. I've always been told if you ever get a DUI, financially you will come out ahead if you fight it. It costs about $10,000 in lawyer fees to get a DUI dropped (but you may save that per year in car insurance). Although I have no idea how the cocaine possession should have affected the case, though our drug laws aren't usually something druggies are scared of. Maybe thats what the $500 fine was for.

Well this "scandal" is really the only reason any of you would know. I learnt about it when a friends FB status mentioned Rahim Jaffer's name was in the top ten most searched phrases on Yahoo.

Jaffer got off because the Crown Attorney felt that his rights were infringed because he wasn't given enough opportunities to contact his lawyer when apprehended. Many other professionals that were consulted by the media disagreed and felt that the charges would have likely stuck.

Unfortunately because of our backlogged courtrooms, it seems that some crown attorneys are willing to drop a case at the least hint of weakness because if a case goes to trial (opposed to taking a guilty plea) they would be forced to do a lot more preparatory work, and risk looking bad in the eyes of their superiors should they wind up losing. Consequently a small crack in a case frequently leads to their acceptance of a greatly reduced plea, or they may drop the charges altogether.

Look at the Michael Bryant case. Again they've avoided a costly trial, perhaps because of the character and past actions of the deceased jeopardizing their prospect of conviction.
