I have downloaded several albums from torrents, simply because my legit copies are too damaged to rip, and because when I bought a new computer, I couldn't get my iTunes Store music onto it.

I didnt put that well did I...

I found a program on Downloads.com that could rip dvds to your compy, but it couldnt decrypt the disc so I asked about it on here. (this was at least 6 months ago) anyway the thread was deleted (I think it was by Art) and I was sent a message saying that decrypting discs is illegal and not to do it

Under the DMCA, using any software to bypass security features on CDs or DVDs is illegal.

The problem with torrents is that anyone who downloads also uploads; that's how a torrent works.

As I recall, several other fileshare programs will often download content to their upload folder, effectively sharing anything downloaded with others.

It's called P2P (peer-to-peer) for a reason, and as such, no-one is 'innocent' -- even when it comes to uploading media to others.

Also, I don't think the US federal government cares a lot about going after people. That's what the RIAA does. They've been known for ridiculous lawsuits.

Not necessarily.

And unfortunately, the punishment doesn't fit the crime at.all. Under current copyright laws, each song can be worth $150,000. Settlements are lower than that, but still hardly pocket change.

This guy got hit with sharing 24 songs, settling at $9,250 per song. That comes to $222,000.

It's a sick system, as much more heinous (and hurtful) crimes only get a figurative slap-on-the-wrist. Not only so, but Congress has been supportive in increasing the punishment for copyright violations.

It was already touched upon, as the sites don't host any illegal material themselves, but also many of the torrent sites you will see are not hosted in USA, so American laws don't apply to them.
With that said, there have been many servers that have been raided, sites taken out, and the guys who run them have gotten in legal issues - oink.cd being the most devastating example I can think of.

Another gray area there - many of the TV networks (and southparkstudios) give you Americans lots of free shows online, but we can't get them in Canada.

I know a guy in Europe got in trouble for one as well. I think he might have been in Germany or something but I don't really remember.

I've been told by Isohunt users that you can download then stop the process before it uploads... but sites like demonoid ban people who do that for leaching.

ps I think they should just make you buy the song, and pay a fine (not over like $100 per song tho...)

If the government spent $100k to catch you in the act of downloading and only fined you $100 per song, wouldn't that be silly?

especially since it would be relatively easy to catch such people.

Why dont they use that 100k to get rapists, molesters, murderers etc? sounds like a waste of taxes.

Only some laws are worth enforcing? Should physical property rights be thrown in the ditch as well? Then we can really invest in catching rapists and murderers. Oh right property rights are basically the single condition that Adam Smith suggested a capitalism needs to work.
