amp shipment:buyer problem on ebay

Hey I'm in a delimma...I bought a $1400 amp about a month ago on ebay using paypal and I haven't received the amp yet. I contacted the seller about 2 weeks ago and he gave me a swift response 3 hours later and this is what he had to say:

"Hello, and thanks again for your swift payment. The amp was sent out late last week after a shipping discrepency I've been having with my local post office. I've had a few shipments go totally missing recently, and I wanted to make sure this would make it to you. It was sent via standard ground(it's been heavily padded). It has gone this method because of it's heavy weight. Just keep an eye out for it on your end as I will on my end as well. After the past few weeks of shipping, I've received 3 items back in the mail that were large. Anyhow, I stand behind my actions, and if there is any further problems, I'd be glad to refund. Thanks again!"

I hope this guy is honest but I have doubts of what he said...he hasn't given me the shipping tracking number which raises flags to his honesty...I've contacted him again about 6 days ago and he hasn't responded since...well during those 6 days I've contacted another buyer from this seller and this is what the buyer had to say:

"This monkey definitely wasn't the best guy I'd ever dealt with. I contacted him about a month almost a month after I'd paid him and never got my skates so I finally contacted him. His excuse was that he tried to mail them and they got returned to him. Unfortunately I deleted his response so I no longer have his contact info. It still gives a contact the seller option on his feedback page so you might want to try that. If that doesn't work best thing to do would be to contact ebay or file a complaint with paypal if you paid with paypal. My vote would be for doing it with paypal if that's how you paid. Those guys don't muck about when it comes to that kind of stuff. Wish I could be of more help. As a funny side note I paid $15.99 total for the skates and shipping ended up costing him like $23. That's what the guy deserves for being a jerk and not shipping people their stuff."

So this seller is pretty much a "scam" which I'm praying he isn't. I'm going to report him to ebay and apply for the paypal buyer's protection which covers up to 1k. I have a question about the payal guidelines...it says that "You may only file one claim per PayPal payment." I was wondering if I claimed that I never received the amp, then the seller then miracously ships the amp and it turns out to be different from the listed amp that I bought from him, can I claim that this was a lemon, aka "fake" or I cannot make a complaint anymore of receiving a lemon after I already made a complaint about not receiving the amp?

I'm really stressed out over this entire transaction. I've worked and saved really hard to purchase this amp for myself and my son to play in church and at gigs and even my wife is pretty mad about this situation. I need all the help I can get ASAP because the complaint for Paypal ends within 45 days of the purchase...and it's almost time to file a claim if I don't and I probably won't receive this amp...My son and I were really looking foward to owning and playing this amp but this has really turned into a big headache. What else can I do to pacify this situation/half of a transaction? God forbid any of you to experience this, but there are a lot of dishonest people so I'm pretty sure at least one of you guys have endured this ridiculous mishap. Please help if you know what to do!

I honestly have no idea what to do, but know that I am praying for you. I would be in contact with a PayPal rep to sort all of this out, and after you finish talking to that person get in touch with eBay. I would contact eBay first, actually, but I don't really know much about this business anyway.

If you haven't received it yet, I would go ahead and file a complaint. I think the seller has 30 days to get the item to you including shipping time. I had to do that on an amp I bought a couple years back, the guy had lots of excuses like "we shipped it to the wrong customer", "didn't have a suitable box", blah blah blah. After I started the complaint, and ebay/paypal sent him whatever notification they send, I got the amp like 3 days later... The response you received sounds like doublespeak to me, start the complaint process....

I agree, I would file a complaint on ebay and have them help you deal with it.

Go ahead and file on ebay first. Then depending on how they respond, you should file on Paypal.

Buying from ebay is tough. I have had a couple instances where the gear isn't quite what was advirtised. Hope everything works out for you.

Hey thanks guys...this seller replied to last night after I made a threat of reporting and he said:

"I am glad you contacted me. The amp i got back in the mail was indeed the one i sent you. My account was suspended because my fathers account was withheld because of a late payment. Ebay deceided to suspend accounts with the same last name. Im in process of working this out. You made your payment via paypal, and my paypal account is in working order. If you felt you were being ''played with'' paypal has a simple dispute process that gets your money back very simply. I am an honest seller, and i would never do a crooked transaction. This is a simple case of the mail being returned to me. Please let me know if you would like me to reship the amp. Ive already paid for shipping once, but since you've been inconveinced, id offer to pay for the reshipment. Let me know what you'd like me to do. I'm reasonable, and can resolve this nicely."


Hopefully this turns out to be fine..so this headache will be over..Well thanks for your input guys!

Huh? Something is still not adding up. Why whould it get shipped back to him because of a supposed suspended eBay account?

None of that makes sense to me.

None of that makes sense to me.
also, why would you need to get your money back via pypal dispute? It's Paypal...I've done plenty of lateral money transfers through them.

This looks like a job for SMALL CLAIMS COURT!!! He'll send that amp then...

It still sounds a little fishy. How could the amp be stopped mid-delivery to be returned, because of a suspended account? How would the delivery service find out? That doesn't quite add up.
Anyways, if you ask him to ship it again(if he is truthful about it being returned to him) get a tracking number.

I think the reason that he mentioned the accoutn suspension isn't because of the mailing, but because of the slowness in returning his contact.
