The most likely reason that he wants you to file a Paypal dispute rather than give you a refund directly is probably because he doesn't have the money anymore. I would go ahead and file a dispute and leave a negative feedback to warn others.

OK here's an update from the seller...

"I promise you I will be refunding you. You don't have to goto the expense of court. I have just transfered the funds from my bank account to my paypal account yesterday. Paypal says it will take possibly 3 business days to get it into my account. I am still communicating with you as best I can. The second the money is available in my account, It will be sent. When making a refund, it normally has to go via echeck. As soon as you get indication of the return, it will state uncleared in your account for a couple days. As soon as you see the return is pending, that means the money has left my account, and is in transit to your account. I've delt with thousands of transactions via ebay, and I assure you it's not worth getting into legal trouble over this little amount of money. If you have any questions, I appriciate your emails. Thanks again."

I hope all goes well....I don't smell anything fishy here...is there? Well thanks for all of your advise!

I'd watch that whole "return is pending...and is in transit to your account" deal. IMO, $1400 isn't a "little amount of money" unless you're just milking the cash cow. I'd still be vigilant over the next week and make sure your money gets deposited.

also, FWIW, small claims court (if this fell into small claims, which the amount might be too high) is very inexpensive. There are no lawyers involved.

Sounds like a legit statement. It does take about 3 business days for transfers from a checking account. I would stay on it though.

I'm curious, what was his rating before you won the amp? I'd tend to trust the history, good or bad.

I just got another great eBay deal, a used Ampeg B50-R bass amp for under $300 that was shipped in 5 days! It was well packed too. Of course, the seller had a great rating. I've found that to be the key to all my good transactions, big and small.

Id be a little less harsh on the guy. I got a peavey Generation a week ago. I had purchased it over a month ago. The USPS sent it on a very, very long journey. Now the seller had insured it and had registered it, so I could see he had shipped it. It eventually arrived and is a fine guitar.

USPS does tend to screw up.

Now I would be cautious, but chances are there could well be some funny business on all parts here. I would request he resend the amp UPS or refund my money ASAP.

Having dealt with paypal, his last statement is fully legit.

USPS certainly does tend to screw up. That and their tracking system is pretty much useless. All you can ever get from it is "Electronic shipping info received", when it arrived at your local post office and when it was delivered. If you want any clue on how far along it is in the journey or when to expect it you're out of luck.
