Legal Question...

I'm sorry if this is in the wrong place. It's kind of an oddball... but I need answers.

Two and a half years ago I moved into a small apartment with a friend. He had a lot of crap we couldn't possibly fit in there, so my parents let him use their basement for storage. One year later, we moved out... his crap has been sitting there since. We have tried contacting him countless times over the last year and a half. At some point, does the stuff "legally" become ours... to sell on eBay...

I'm no law student, but I'd say definately not. Not that I wouldn't be tempted to get rid of it either...

Since he didn't declare that the property has been exchanged to you you have no right to it. He would have a right to get it back somehow, or at least be reimbursed.

On the other hand, if you have no proof that you were to store the stuff and he had no proof it's not like he could be very successful in pressing charges...but just to keep safe I personally wouldn't do it... unless I had it for 50 years or something ridiculous like that.

By the way: I'll keep the thread here. I don't think we have "legal" forums... this is the closest.

I'd tend to think the other way. He's put stuff on your property with no agreement from you? It's littering. Something about posession being 9/10ths and all.

But I'd ask a local lawyer.

or call the local sherrif or whoever is generally incharge of evictions in your area.

ive been in this situation before, if theres no written/signed agreement between you, hes out of luck, howveer i would suggest just getting rid of it, if he comes back to get it later on down the road, and he can somehow prove its his, he can take it. and if any of its maybe damaged purposely or not, he can cause a stink about it... basically you should just get rid of it, its no longer your problem once its off your property
