Last time I checked, "Happy Birthday" was still copyrighted. That's why when you go into a restaurant and someone is having a birthday... they don't sing "Happy Birthday". They sing some other song (often including the name of the restaurant) rather loudly and with a lot of intense clapping.

Studies have shown that a simple adjustment in a song makes it into a different song. Take Mr. Ice's well known song "Ice, Ice Baby" which had the entire beat stolen from another song, "Under pressure". When he was taken to court, he changed one beat to a lower octave than it origionally was and got of scott-free. Thus, "Happy Birthday, dear mommy" is an entirely new song, not yet copyrighted.
